Q 1:
Is Nikah (concluding a marriage contract/having sexual intercourse) permissible with a pregnant woman?
What did the Messenger of Allah (peace be upon him) say about this?
A:
If the meaning of the question is: is it possible to conclude a marriage contract with a woman who is pregnant by another man, this is not permissible, as she is still in her ‘Iddah (woman’s prescribed waiting period after divorce or widowhood). It is not permissible to marry her because Allah (Exalted be He) says (what means): (Part No. 18; Page No. 247)
And do not consummate the marriage until the term prescribed is fulfilled. And know that Allâh knows what is in your minds
He (Glorified be He) also says:
And for those who are pregnant (whether they are divorced or their husbands are dead), their ‘Iddah (prescribed period) is until they lay down their burden
If the meaning is: is it permissible for a husband to have intercourse with his pregnant wife, there is nothing wrong with this, because Allah did not make it Haram (prohibited) for a man to have intercourse with his wife, except during the menstrual or postpartum periods, or when in Ihram (ritual state for Hajj and ‘Umrah). May Allah grant us success. May peace and blessings of Allah be upon our Prophet Muhammad, his family and Companions!
