Q: Two days ago, while I was praying in the Masjid (mosque), I was told that a blind man was asking about me. When I went to him, he said to me that one of his sons died while leaving behind children.
He asked whether these children are entitled to inherit the prescribed share their father was supposed to receive after the death of their grandfather. Will there be any sin against him if he does not assign them any share of inheritance?
A:
If the reality is as you mentioned, the children are not entitled to any shares in the property left by their grandfather as it will be an exclusive right to their grandfather's sons. They will not be compensated for the death of their father. Upon the death of their grandfather, they will be totally excluded from inheritance due to the presence of their grandfather's sons. It should be made clear that no one will bear the sin of excluding them from receiving shares in the property left by their grandfather upon his death. However, it would be kind if, out of solacing and showing sympathy, their uncles assign them a portion of the property when it is distributed. Allah (Exalted be He) says,
And when the relatives and the orphans and Al-Masâkîn (the poor) are present at the time of division, give them out of the property, and speak to them words of kindness and justice.
