Death of a depositor who has heirs

359

Q 1: My mother asked me to do some repairs for an amount of silver. A few days later she died, and the silver remained with me. I have 3 brothers and 6 sisters. One of the 3 brothers died and left a family. What is the Shari`ah ruling on this? May Allah reward you with the best.

(Part No. 15; Page No. 422)  A: The silver your mother gave you to repair before her death is for her rightful heirs just like the rest of her inheritance. As for your brother, if he died after your mother, his share goes to his rightful heirs according to the Shari`ah (Islamic law) of distributing inheritance. May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
