Disposing of the Diyah collected from the tribe after a charitable man has paid it

Q: My brother (S.Y.F) died in a car accident that also resulted in the death of the other party (H.T.D). The General Traffic Department decided that my brother was fully responsible for the accident, therefore, we were charged with the Diyah (blood money) to be paid to the heirs of H.T.D. By the end of Ramadan, 1408 A.H. My family (Part No. 21; Page No. 242) collected the Diyah evenly amongst them and have given it to me to submit it to the court authorities. When I asked for an appointment with the heirs' attorney, I was informed that the Diyah sum was paid by a unanimous benefactor. My question is: Am I entitled to dispose of this money as the delegate of my family, especially as my father asked me to give him some of the money since he is in bad need for money to run our farm and revive some of our property? Can I take some of this money, too? I appreciate your guidance, may Allah bless you!


A: You must return the money you took to pay the Diyah to your family, since the purpose for which the money was collected has been abated. If however your family assigns the money to a certain person, in this case the money should be given to that designated person.May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
