Inheritance of a wife whose marriage is not consummated

Q: A man called Hassan married his cousin by a legal marriage contract and gave her a car that is worth 15,000 SR as a dowry in addition to 6,000 SR in cash. This man died before consummating the marriage.The question here is: Does the woman deserve a share of inheritance from the legacy of her husband, Hassan who died before consummating the marriage? It is worth mentioning that her family asks for her share in the legacy. She is twelve years old now. We are waiting for your Fatwa.


A: If the reality is as mentioned, that Hassan married his cousin and died before consummating the marriage, she should inherit one eighth from his estate if he had children and one fourth of it if had no children, after repaying his debts if he is indebted and executing his legal will if he made one.
