Giving people a Fatwa different from that adopted by the Jumhur

Q 4: One of the guides in an organized Hajj group instructed the pilgrims that no Muqallid (strict follower of a specific School of Jurisprudence) is allowed to give the people a Fatwa (legal opinion issued by a qualified Muslim scholar) different from that adopted by the Jumhur (dominant majority of scholars). No one may give a Fatwa different from that of the Jumhur except a Mujtahid (a scholar qualified to exercise juristic effort to infer expert legal ruling) such as Ibn Baz (may Allah be merciful to him). Some of the students of knowledge among us, (Part No. 11; Page No. 15) when asked before the occurrence of an action, give a Fatwa of the Jumhur; and when asked after its occurrence, give a Fatwa of any Imam apart from that of the Jumhur.The question: Is the opinion of the guide of the Hajj group correct that the only Fatwa that should be given before and after the occurrence of the action is that of the Jumhur, in spite of the hardship that the questioner may encounter when repeating their inquiry? Please give us your Fatwa, may Allah reward you.


A: The Mufty (Islamic scholar qualified to issue legal opinions) should give the Fatwa that is preponderant according to evidence, if he has enough competence and knowledge to do so; otherwise, he should refer the question to any other scholar.May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
