Q 1: What is the ruling on having sexual intercourse
with one's wife during her menstruation?
A:
Having sexual intercourse with one's wife during her menstruation is unlawful according to the Words of Allah (Exalted be He):
They ask you concerning menstruation. Say: that is an Adha (a harmful thing for a husband to have a sexual intercourse with his wife while she is having her menses), therefore keep away from women during menses and go not unto them till they are purified (from menses and have taken a bath). And when they have purified themselves, then go in unto them as Allâh has ordained for you (go in unto them in any manner as long as it is in their vagina).
It is not permissible for a husband to have sexual intercourse with his wife during her menstrual period until it comes to an end and she performs after-menstruation Ghusl (full ritual bath), based on the Ayah (Qur'anic verse) previously mentioned. Any husband who has sexual intercourse with his wife during her menstrual period or before she performs Ghusl will be sinful for committing an act that Allah has forbidden. The man concerned must repent to Allah of such an abominable act and offer a Kaffarah (expiation). The Kafarah for committing such a sin is to give a Dinar or half a Dinar to charity for the poor, according to the Hadith narrated by
Ibn `Abbas (may Allah be pleased with him and his father) that the Prophet (peace be upon him) said about the person who had sexual intercourse with his wife during her menstrual period: "He has to give a Dinar or half a Dinar to charity." A Dinar is equivalent to four-sevenths of a Saudi pound. If the Saudi pound (Part No. 4; Page No. 226

If the Saudi pound (Part No. 4; Page No. 226) is worth seventy Riyals for example, the person will have to give forty or twenty Riyals to charity for the poor as a Kaffarah.May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
