Q 6: A man had sexual intercourse with his wife during the daytime in Ramadan. He knew the Fatwa (legal opinion issued by a qualified Muslim scholar) about this from the people of knowledge but he could not find a Muslim slave to free and he could not fast. The only option he has now is to feed the needy. This took place three years ago. Is he sinful because he delayed making up for this day and is there a required Kaffarah (expiation)?

If
a man has sexual intercourse with his wife in the daytime in Ramadan, he is obliged to make up for it and to observe the Kaffarah, which is to emancipate a Muslim slave. If this is not possible, he is to fast two successive months. If he is also unable to do that because of illness, old age, and the like, he should feed sixty needy persons. If a person is required to make a Kaffarah, he should hasten to observe it to absolve himself of it. If he delays it with no excuse, he should repent to Allah (Exalted be He) and hasten to do it for there is no Kaffarah for that except doing it.May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
