He purchases a car and leaves it in the gallery till selling it

398

A: If you buy a car or any other object, it is impermissible to sell it until you have full possession of it through removing it from the seller's place to yours. This is because the Prophet (peace be upon him) (Part No. 11; Page No. 80) forbade selling items on the spot before taking them to their places. As for the fact that the buyer purchases the car from you when he is not in need of it but wants to sell it due to his financial need, this has nothing to do with you and there is nothing wrong upon you provided you do not buy it from him. This transaction is called Tawarruq sale (selling by installments, then the purchaser sells the product to a third party for cash) and it is permissible according to the Jumhur (dominant majority of scholars).May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
