Taking from the estate of the deceased a sum of money covering the expenses of Hajj to perform it on his behalf

Q 1: My paternal uncle died leaving a great estate and had no children. He did not perform Hajj though he was physically and financially able. Should one of his brothers perform Hajj on his behalf using part of his estate or not? (Part No. 10; Page No. 66


A: A sum of money that covers the expenses of Hajj from the hometown of the deceased should be taken from his estate to perform Hajj on his behalf, on the condition that the one who will perform Hajj on his behalf, whether a relative or non-relative, has already performed Hajj for himself first.May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
