Q: A questioner asks about
the agreement of Al Yahmad tribe to establish a fund according to a foundational memorandum,
which includes five items with (Part No. 11; Page No. 224) numerous clauses.

After considering the attached agreement, it is clear that it includes financial obligations that must be fulfilled by members of the tribal kinship. Any member of the tribe, who does not participate in the agreement, is considered as separated from the kinship and should undertake the consequences. Hence, it is not permissible to agree on these conditions or to bind people by them, because these obligations have not been obligated by Allah or His Messenger. Also, it may break the ties of kinship and cause hatred and disagreement, a result that completely contradicts the purposes of the purified Shari`ah (Islamic law), such as friendliness, love and cooperation between relatives.May Allah grant us success.
